Central Information Commission raps Puducherry for RTI violation

 The Central Information Commission has pulled up Puducherry government for violating provisions of the RTI Act by appointing a single person as public information officer as well as the first appellate authority in a government college. 

The case relates to some information sought by RTI activist L Selvam Flaubert from Bharathiar Palkalaikoodam, a government performing arts college in Puducherry. Information commissioner Yashovardhan Azad, who heard an appeal from Flaubert through videoconferencing on August 2, asked the chairman of the college to rectify the mistake of appointing the same person as public information officer as well as the first appellate authority. 

Azad also pulled up the government for not providing full information - year of establishment of the Karaikal branch of the college, number of employees engaged with names, salary and wages, budget allocation and reasons for closure of the branch - sought by Flaubert. 

The PIO and the first appellate authority, while providing much of the information sought by the RTI activist, said the reason for closure could not be provided as the relevant records were untraceable. The commission directed the government to conduct an inquiry to fix responsibility on officials concerned for loss of records. The government has to send the action taken report to the commission within a month. 

The public information officer, on June 15, 2012, sought three months time to furnish reasons for closure of the Karaikal branch of the college. He said the files were not traceable and he needed time to search them. An appeal to the appellate authority also evoked a similar response on October 30, 2012. 

The activist then preferred an appeal before the central information commission on November 5, 2012. In his complaint, the activist charged that the PIO was deliberately hiding information.

"தகவல் உரிமைச் சட்டத்தின் கீழ் தீர்ப்புகளுக்கான காரணங்களை வெளியிட முடியாது'

தீர்ப்புகளுக்கான காரணங்களை தகவல் அறியும் உரிமைச் சட்டத்தின் கீழ் வெளியிட முடியாது என்று உச்ச நீதிமன்றம் தெரிவித்துள்ளது.
ரவீந்தர் ராஜ் என்ற சமூக ஆர்வலர், உச்ச நீதிமன்றத்தின் பொதுத் தகவல் அதிகாரியிடம் தகவல் உரிமைச் சட்டத்தின் கீழ் ஒரு மனுவைச் சமர்ப்பித்திருந்தார்.
அதில், "விசாரணை ஏதும் நடத்தப்படாமலும், எந்தக் காரணமும் கூறப்படாமலும், மறுசீராய்வு மனுக்கள் மீது நீதிமன்றங்கள் சில உத்தரவுகளைப் பிறப்பிக்கின்றன. அந்த உத்தரவுகளுக்கான அடிப்படைக் காரணங்கள் என்ன என்ற தகவலை வழங்க வேண்டும்' என்று கோரியிருந்தார்.
அந்தத் தகவலை வழங்க தகவல் அதிகாரி மறுத்து விட்டார். இதையடுத்து, உச்ச நீதிமன்ற மேல் முறையீட்டு அதிகாரியிடம் ரவீந்தர் ராஜ் முறையீடு செய்தார்.
அவரது மனுவை மேல்முறையீட்டு அதிகாரி தள்ளுபடி செய்து, பிறப்பித்த உத்தரவில் கூறியிருப்பதாவது:
கண்ணபுரம் வழக்கில் உச்ச நீதிமன்றம் அளித்த தீர்ப்பில், "ஒரு நீதிபதி, தான் அளிக்கும் தீர்ப்பு மற்றும் பிறப்பிக்கும் உத்தரவின் மூலம்தான் பேசுகிறார். சம்பந்தப்பட்ட வழக்கில் நீதிபதி, ஒரு குறிப்பிட்ட முடிவுக்கு ஏன் வந்தார், அதற்கு என்ன காரணம் என்ற விவரத்தை தகவல் உரிமைச் சட்டத்தின் கீழ் கோர யாரையும் அனுமதிக்க இயலாது' என்று தெரிவித்துள்ளது.
இந்தத் தீர்ப்பின் அடிப்படையில், தற்போது தகவல் உரிமைச் சட்டத்தின்கீழ் கேட்கப்பட்டுள்ள மனுவில் எந்த முகாந்திரமும் இல்லை என்று அந்த உத்தரவில் மேல்முறையீட்டு அதிகாரி கூறினார்.

அரசு ஊழியரின் ஊதியத்தை அறிந்து கொள்ள மக்களுக்கும் உரிமை உண்டு.

அரசுப் பணியில் உள்ள கணவரின் ஊதியத்தை அறிந்துக் கொள்ள மனைவிக்கு முழு உரிமை உண்டு என்று மத்திய தகவல் ஆணையம் விளக்கம் அளித்துள்ளது.

டெல்லி அரசின் உள்துறை அமைச்சகத்தில் பணியாற்றும் தனது கணவரின் ஊதிய விவரங்களை அளிக்குமாறு தகவல் அறியும் உரிமைச் சட்டத்தில் ஜோதி ஷெராவத் என்பவர் மனு தாக்கல் செய்தார்.

ஆனால் ஊதிய விவரங்களை ஜோதிக்கு அளிக்கக்கூடாது என்று அவரின் கணவர் எழுத்துபூர்வமாக கேட்டுக் கொண்டார். இதைத் தொடர்ந்து ஊதிய விவரங்களை அளிக்க டெல்லி உள்துறை அமைச்சகம் மறுத்துவிட்டது.

இதுதொடர்பாக மத்திய தகவல் ஆணையர் ஸ்ரீதர் ஆச்சார்யலுவிடம் மேல்முறையீடு செய்யப்பட்டது. இந்தப் புகாரை விசாரித்த அவர், ஜோதி ஷெராவத்தின் கணவரின் ஊதிய விவரங்களை உடனடியாக அளிக்குமாறு உத்தரவிட்டுள்ளார். இதை செய்யத் தவறினால் கடும் நடவடிக்கை எடுக்கப்படும் என்று டெல்லி உள்துறை அமைச்சகத்தை அவர் எச்சரித்துள்ளார்.

பொதுமக்களுக்கும் உரிமை உண்டு

இந்த விவகாரம் தொடர்பாக அவர் அளித்துள்ள விளக்கம் வருமாறு: கணவர் அரசு ஊழியராக இருந்தால் அவரின் ஊதிய விவரங்களை அறிந்துக் கொள்ள மனைவிக்கு முழு உரிமை உண்டு.
மேலும் மக்களின் வரிப் பணத்தில் இருந்துதான் அரசு ஊழியர்களுக்கு ஊதியம் வழங்கப்படுகிறது. எனவே அரசு ஊழியரின் ஊதியத்தை அறிந்து கொள்ள மக்களுக்கும் உரிமை உண்டு. இதுதொடர்பாக அளிக்கப்படும் மனுக்களை அரசுத் துறைகள் நிராகரிக்கக்கூடாது என்று ஸ்ரீதர் ஆச்சார்யலு தெரிவித்துள்ளார்.

Government issues guidelines for better implementation of RTI Act

The Department of Personnel and Training (DOPT), Ministry of Personal public Grievances and pensions, government of India, issued a guideline and templates for better implementation of section 4 (1) (b) of the Right to Information Act (RTI) and asked the states and union territories to implement it to bring transparency into the administration at local level.
According to sources, in order to further improve the proactive disclosure, government of India constituted a task force on Suo Moto disclosure in May 2011 which included representatives of civil society organizations active in the field of RTI.
Sources said that section 4 (1) (b) of the RTI act lays down the information which should be disclosed by public authorities on pro active basis. The purpose of the pro active disclosure is to place large amount of information in public domain on a proactive basis to make functioning of the public authorities more transparent and also to reduce the need for filling individual RTI applications.
Though, experiences suggests that governments have not been implementing it and people have to file RTI applications which ideally should be available on pro-active disclosure where one need not to file an RTI application.
The task force recommended guidelines for disclosure by state governments along with templates for disclosure at various levels. Four Illustrative templates have been recommended for disclosures under Public Distribution System (PDS), Panchayats, MANERGA, Primary and Secondary schools. These four areas have been selected on the ground that they constituent some of the most significant services being provided at the ground level.
"The templates would not only improve the quality of disclosure but would also facilitate more transparency in governance'' says Pankti Jog of Mahiti Adhikar Gujarat Pahel (MAGP), one of the constituents of Task force.
"If the guidelines and templates of pro-active disclosures implemented, it will help a lot to bring transparency in administration and lower the pendency of appeals before the Gujarat Information Commission (GIC) as citizen have to approach to GIC even in matters which should be available on pro-active disclosure'' Jog said.
The templates and guidelines issued by government provide the methods about how the information at local level should be displayed or make available pro-actively.
